Release and Assumption of Risks: I am aware that during the avalanche/climbing/ or backcountry courses that I am participating in under the arrangement of Tahoe Mountain School, certain risks and dangers exist including, but not limited to, travel by air, automobile or other conveyance, travel in mountainous terrain, the forces of nature, accident, injury, illness, paralysis or death in remote places without rapid means of evacuation or medical facilities.

In consideration of, and as part payment for, the right to participate in such course, and services arranged for me by Tahoe Mountain School, its instructors, guides, agents and associates, I have and do hereby assume all of the above risks and will hold them harmless from any and all responsibility, negligence, actions or suits of any kind or nature whatsoever for loss or damage to property or personal injuries sustained or occurring during any course, guided trip, or activity of any nature. This shall serve as release and assumption of risk for myself, my heirs, administrators, executors, and for all members of my family including minors who may be accompanying me. I agree that if I sue or make any claims against Tahoe Mountain School, in violation of this waiver, I shall be liable to Tahoe Mountain School for all costs and attorneys' fees incurred by Tahoe Mountain School in defending itself from such action or claim.

Cancellation and Refund Policy:

If you need to cancel your course or trip for any reason (including medical), Tahoe Mountain School requires written notice in our office 14 days in advance of the first day of the course.  With 14 days or more notice we can refund your payment minus 20% for administrative costs.  Once we are within 14 days of the first day of the trip, we unfortunately cannot refund any portion of your payment even in the event of sudden illness or injury to you or your family.  We recommend that you buy trip cancellation insurance (available through your travel or insurance agency) in case you get sick or injured before or during the trip.  If TMS must cancel a course or trip due to inadequate registration, extreme weather circumstances, etc. you will receive a full refund or can be switched to another TMS course. However, TMS is not responsible for additional expenses incurred including non-refundable airline tickets, equipment, medical expenses, lodging, etc.

Travel and weather in the mountains can be difficult at times. Winter weather can have a significant impact on travel times, with temporary road closures, chain control, traffic, poor visibility, and other issues all possibly contributing to delays.  Additionally, there is a certain amount of inherent risk involved with winter driving in the mountains.  We recommend that all participants take the time to be prepared for unforeseen circumstances or delays. As these issues are a normal part of mountain travel, Tahoe Mountain School will not cancel courses due to weather or challenging travel conditions.

On any course or trip, our guides reserve the right to remove any person for any reason. These reasons would generally stem from a person jeopardizing the safety of themselves or others.  This includes a person who is not physically able to climb or ski/ride at the level necessary for the chosen course or trip objective. In all these cases, there are no refunds whatsoever, and the client will be responsible for any additional costs incurred in leaving the trip.

I have read and do agree to the "Cancellation and Refund Policy" and all conditions under the "Liability Release Form" as stated by Tahoe Mountain School.  I understand and agree that my contract with Tahoe Mountain School is entered into in Truckee, California, upon my being placed on the course or trip roster. This waiver shall be interpreted in accordance with the laws of the State of California.
